Terms and Conditions

TERMS OF USE

Effective Date: October 29, 2026
Last Updated: October 29, 2026

PLEASE READ THESE TERMS CAREFULLY. These Terms of Use (“Terms”) govern the Alien Workshop website (“Site”) and purchases from it. The Site is operated by Orange Tape, LLC (“Orange Tape,” “we,” “us,” or “our”), 13214 NE Whitaker Way, Portland, OR 97230. By using the Site or submitting an order, you agree to these Terms, subject to any mandatory consumer rights that cannot be waived. If you do not agree, do not use the Site. Updated Terms will be posted with a new date and appropriate additional notice for material changes. Changes will not retroactively alter completed purchases or preexisting disputes.

1. ELIGIBILITY AND ACCOUNTS

You may use the Site and purchase products in accordance with applicable law. If you are under 18, we encourage you to review these Terms with a parent or legal guardian. You must provide accurate account and checkout information and safeguard account credentials. Notify hello@alienworkshop.com if you suspect unauthorized access. We may suspend accounts for misuse, subject to applicable law.

2. PRODUCTS, PRICES AND ORDERS

Product availability, specifications, images and pricing may change. We aim for accurate listings but may correct errors. Orders are offers to purchase and are subject to acceptance, inventory availability and fraud screening. If an accepted order cannot be fulfilled, we will provide a refund of amounts paid as required by law. Taxes, shipping charges and other mandatory charges will be disclosed at checkout as required. Where international delivery may involve import duties, customs charges or taxes not collected at checkout, we will disclose their existence and who is responsible before purchase as required by applicable law. An order confirmation does not waive statutory rights.

3. SHIPPING, DELIVERY AND RISK OF LOSS

Our Shipping Policy, linked at checkout or in the Site footer, provides available shipping methods, costs, delivery estimates and destinations and is incorporated into these Terms to the extent consistent with mandatory law. Delivery estimates are not guaranteed unless expressly agreed. Title and risk of loss transfer only as permitted by applicable law. In jurisdictions where the seller is responsible until the consumer or a designated recipient takes physical possession, we remain responsible until that point, subject to lawful exceptions such as use of a carrier independently arranged by the customer. Contact hello@alienworkshop.com promptly regarding missing, incorrect or damaged items. We encourage reporting shipping issues within 72 hours and providing photos where reasonably possible, but that request does not limit mandatory legal remedies, warranty rights or applicable complaint periods.

4. RETURNS, WITHDRAWAL AND PRODUCT WARRANTIES

Our Return Policy explains ordinary returns, refund methods and procedures. Unless applicable law provides otherwise, clearly identified clearance/final-sale goods may be nonreturnable for change-of-mind reasons; that restriction does not affect defective-product remedies or legally required withdrawal rights.

EEA consumers generally may withdraw from a distance purchase within 14 days after receiving goods, without giving a reason, subject to statutory exceptions. UK consumers generally have comparable cancellation rights under applicable law. Eligible consumers can notify hello@alienworkshop.com using an unequivocal statement within the cancellation period and return goods in the statutory period. Where required, we will refund payments, including qualifying standard outbound delivery charges, within the applicable statutory deadline and using the original payment method unless otherwise agreed; lawful conditions on withholding reimbursement until goods are received or evidence of return is provided may apply. Consumers may be responsible for direct return-shipping costs only if properly informed beforehand, and may be responsible for reduced value from handling beyond what is necessary to examine goods as permitted by law. The Return Policy must supply required instructions, any statutory model withdrawal form, and a convenient electronic withdrawal method where required.

EEA consumers also receive applicable statutory conformity remedies, generally including a minimum two-year legal guarantee, and UK consumers receive rights under UK consumer law. These cannot be excluded by a sale label, short reporting window or these Terms. If your goods are defective, not as described or otherwise nonconforming, please contact us.

If we later offer genuinely personalized products made to your specifications, statutory withdrawal exceptions may apply to those products where legally available and properly disclosed before purchase. They do not eliminate rights concerning defective or nonconforming goods.

5. SITE MATERIALS AND INTELLECTUAL PROPERTY

The Site and its content, including designs, graphics, trademarks, photographs, videos, copy and software, belong to Orange Tape or its licensors and are protected by law. You may view and retain reasonable copies for personal, noncommercial shopping purposes without removing ownership notices. Other reproduction, scraping, redistribution, framing or commercial use requires permission unless permitted by law. Alien Workshop names and logos are trademarks of Orange Tape or their respective owners.

6. USER CONTENT AND REVIEWS

If the Site provides reviews, comments, photos or other public submission features, you must have rights and permissions for content you submit, including any required rights of persons depicted. You retain ownership. By voluntarily posting content to a public review or community feature, you grant Orange Tape a nonexclusive, worldwide, royalty-free license to host, reproduce, adapt for display, distribute and use that content in connection with the Site and promotion of the relevant products and business, subject to applicable privacy and consumer law. You represent that you have rights needed to grant that license and will not submit unlawful or infringing content. We may moderate or remove submissions as permitted by law. We do not endorse content posted by other users.

If the Site later offers custom printing or customer-uploaded artwork for manufacturing, the act of providing private artwork solely for a custom order grants us only the limited rights reasonably needed to review, reproduce, manufacture and deliver that order and handle related support or legal requirements; it does not by itself authorize public promotional use of the artwork. You may not submit infringing, unlawful, abusive or otherwise prohibited materials. We may refuse unlawful or infringing designs, subject to applicable refund and consumer law. Any custom-product exclusions or extra conditions will be disclosed before the order is placed.

7. PROHIBITED USE

You may not break applicable law; infringe intellectual property, publicity or privacy rights; post threats, harassment or unlawful content; impersonate others; attempt unauthorized access; interfere with site security or operation; submit malware; collect others’ private information unlawfully; or use automated tools to extract content at scale without authorization, except where such restriction is unenforceable under applicable law. We may investigate and restrict misuse.

8. COPYRIGHT COMPLAINTS

Send copyright notices identifying the work, allegedly infringing material and its Site location, your contact information, a good-faith statement, an accuracy/authority statement under penalty of perjury, and signature to: Orange Tape, LLC, Attn: Copyright Agent, 13214 NE Whitaker Way, Portland, OR 97230; hello@alienworkshop.com. This contact description does not itself represent that a DMCA agent registration has been completed. We may terminate repeat infringers in appropriate circumstances, consistent with applicable law.

9. FEEDBACK

We may use unsolicited suggestions and feedback without compensation or obligation, except as otherwise required by law or separately agreed. Do not send material you consider confidential without a written agreement.

10. TEXT MESSAGES AND EMAIL

If we make marketing text messages available, enrollment requires the legally applicable separate consent and is not a condition of purchase. Recurring messages may include promotional offers, abandoned-cart reminders (where authorized), review requests and order information. Message frequency varies; carrier charges may apply. Reply STOP to cancel and HELP for assistance, or contact hello@alienworkshop.com. We honor other legally recognized revocation methods. We do not treat general acceptance of these Terms as marketing consent. Marketing emails include an unsubscribe method; necessary order and account messages may continue. Applicable marketing timing, opt-in and opt-out requirements in recipients’ jurisdictions control.

11. SKATEBOARDING SAFETY

SKATEBOARD AT YOUR OWN RISK. Skateboarding is inherently dangerous and can result in falls, collisions, property damage, serious injury, permanent disability, or death, even when appropriate precautions are taken. You voluntarily assume the ordinary risks inherent in choosing to skateboard and are responsible for assessing your abilities, surroundings, and riding conditions. Always inspect your board and equipment before use; wear appropriate protective equipment, including a properly fitted helmet; follow applicable laws; and avoid traffic, hazardous terrain, unsafe conditions, and riding beyond your abilities. Do not skate while impaired. To the extent permitted by applicable law, Orange Tape is not responsible for injuries or losses arising solely from the inherent risks of skateboarding or from your misuse of products. Nothing in this section excludes or limits liability for defective products, our negligence where liability cannot lawfully be excluded, or any other non-waivable legal rights or remedies.

12. WARRANTIES AND SITE AVAILABILITY

To the extent permitted by law, the Site and informational content are provided “as is” and “as available” without a guarantee of uninterrupted service or error-free operation. This statement does not exclude statutory product warranties, mandatory consumer guarantees, or rights concerning goods that are defective, unsafe or not as described.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Orange Tape and its personnel and providers are not liable for indirect or consequential losses that were not reasonably foreseeable or otherwise recoverable under applicable law. We do not exclude or limit liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, statutory product liability, or any other liability or remedy that cannot lawfully be excluded or limited. Nothing in these Terms limits mandatory rights to cancellation, delivery, repair, replacement, price reduction, refunds or compensation. For claims that applicable law permits us to limit, any limitation must be reasonable and enforceable under governing law; no blanket purchase-price cap applies to mandatory consumer remedies.

14. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Orange Tape against third-party claims and reasonable costs arising from your unlawful, infringing or intentionally improper submissions or misuse of the Site, but not to the extent caused by our own negligence, unlawful conduct or matters for which consumer law prohibits indemnity.

15. THIRD-PARTY SERVICES

Third-party websites and services may have their own terms and privacy practices. We do not control them, but nothing here limits responsibility imposed on us by law.

16. PRIVACY

Our separate Privacy Policy explains how we process personal information and how to exercise privacy rights. Acknowledging the policy is not consent to processing where separate affirmative consent is required.

17. TERMINATION

We may suspend or terminate access for material misuse or unlawful conduct, subject to applicable law. Provisions intended to survive, including intellectual property, applicable licenses, limitations and dispute provisions, survive to the extent legally enforceable.

18. GOVERNING LAW AND CONSUMER RIGHTS

Oregon law governs these Terms to the extent permitted by law, without regard to conflicts principles. Subject to mandatory consumer protections, disputes may be brought in state or federal courts in Multnomah County, Oregon. Consumers in California, the EEA, UK or other jurisdictions retain protections and court access that cannot be displaced by a choice-of-law or forum clause. The UN Convention on Contracts for the International Sale of Goods does not apply where exclusion is lawful.

19. GENERAL

If a provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. We may assign rights in connection with a legitimate business transaction, subject to consumer rights. The Terms together with the applicable Shipping Policy, Return Policy and any checkout-specific disclosures form the agreement relating to use of the Site and purchases, except where mandatory law or another express written agreement applies.

20. CALIFORNIA CONSUMER NOTICE

Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services, California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210. Contact the seller using the address/email in Section 21.
